License terms

Who this is between

This agreement is between damirissimo ("we", the photographer and copyright owner) and the person or organisation named on the license certificate ("you").

It applies to each photograph you license from damirissimo.com. Each license has its own certificate with an id you can verify at pro.damirissimo.com/verify.

What you get

A perpetual, worldwide, non-exclusive license to use the photograph within the limits of the tier you bought. We keep the copyright and may license the same photograph to others.

You may edit, crop, colour-grade and combine the photograph with other material, as long as the result does not misrepresent the people or places in it.

You may use it in work you make for a client, and hand that work to the client. The client may not use the photograph outside that work.

Editorial license

For news, editorial articles, blogs, magazines, books (non-promotional), education and commentary.

Not for advertising, marketing, sponsorship, endorsements or anything that promotes a product, service or brand.

Credit the photograph as "Photo: damirissimo.com" next to it or in the credits, wherever that is practical.

Standard license

Everything the editorial license allows, plus commercial use: websites, social media, online and print advertising, marketing material, presentations, packaging and printed matter up to 250,000 copies in total.

Video and broadcast use with an audience of up to 500,000 per production.

Extended license

Everything the standard license allows, with no limit on print runs or audience.

Products for resale where the photograph is a main part of the value, such as posters, prints, cards, apparel and other merchandise, and templates you sell to others.

What you may not do

Sell, share or give away the photograph file itself, alone or as part of a stock, wallpaper or template collection, except in a template you sell under an extended license.

Use the photograph in a trademark, logo or as the main element of a brand identity.

Use a photograph of a recognisable person in a way that suggests they endorse something, or in a sensitive context (health, politics, sexuality, crime, religion) without their written consent.

Use the photograph to train, fine-tune or evaluate machine-learning models, or include it in a dataset for that purpose.

Use an editorial-only photograph commercially. Photographs sold as editorial only show people, events or property without signed releases.

Releases

We do not hold model or property releases unless the photograph page says so. Photographs offered under standard and extended licenses were chosen because they do not need them for ordinary commercial use, but you are responsible for how you use them.

Payment, refunds and credits

A license takes effect once payment is received. If the file is faulty or not what the photograph page showed, write to us within 14 days and we will replace it or refund you, after which the license ends.

Credits are bought in packs, are tied to the account that bought them, do not expire and have no cash value. Unused credits from a pack can be refunded within 14 days of purchase.

Liability

The photograph is provided as it appears on the photograph page. Our total liability under a license is limited to the amount you paid for it.

If you breach this agreement the license ends and you must stop using the photograph.
